Terms & Conditions of Membership

These Terms & Conditions of Membership ("Terms") govern access to and use of Athlete Unsaid, including the website at athleteunsaid.com and the private Athlete Unsaid online community (together, the "Platform").

In these Terms, "Athlete Unsaid", "we", "us" and "our" refer to Context Goods Trading LLC. "Member", "you" and "your" refer to the individual accessing or using the Platform.
By creating an account, purchasing or activating a Membership, or otherwise accessing the members-only areas of the Platform, you agree to be bound by these Terms and our Privacy Policy.
If you do not agree to these Terms, you must not create an account or use the Platform.
Athlete Unsaid is a private online community intended to provide athletes, former athletes and coaches with a space to discuss experiences relating to sport, performance, pressure, confidence, mistakes, competition and other aspects of the mental side of sport.
The Platform may include peer-to-peer discussions, educational material, mental-performance content, prompts, exercises, commentary and general coaching input provided by Athlete Unsaid or its founder.
Athlete Unsaid is not a medical, psychological, psychiatric, psychotherapy or crisis-support service. Further provisions concerning this distinction are set out in Section 16.
You must be at least 18 years old to create an account, purchase a Membership or use the Platform.
By registering, you represent and warrant that:
Sport, competitive level and role are generally self-declared and are not routinely independently verified.
Athlete Unsaid is intended to remain a community for people with a genuine connection to sport. We therefore reserve the right, where we have reasonable grounds to question eligibility, to request reasonable additional information or clarification.
We may refuse an application or Membership where we reasonably believe that the eligibility requirements are not satisfied.
Payment of a Membership Fee does not by itself create an unconditional right to Membership.
You must provide the information reasonably required to establish and maintain your account.
You are responsible for maintaining the confidentiality and security of your login credentials and for activity carried out through your account.
Accounts are personal and may not be sold, transferred, shared or made available to another person.
You must notify us promptly at info@kristingrube.com if you believe that your account has been accessed without authorization.
We may require you to reset your credentials or take other reasonable security measures where necessary to protect you, other Members or the Platform.
Athlete Unsaid operates on a paid subscription basis.
Different Membership tiers may be offered. The features, eligibility criteria and price applicable to each Membership are those displayed to you on the Platform or at checkout before you subscribe.
Unless expressly stated otherwise at checkout, Membership is billed monthly.
Membership begins when your paid subscription begins or, where an eligible free trial is offered, when the free trial is activated.
Athlete Unsaid may, from time to time and at its sole discretion, offer free or discounted trial periods to eligible new Members.
The availability and duration of any promotional trial will be stated at sign-up.
Unless expressly stated otherwise, only one free trial is permitted per person.
We may refuse, cancel or terminate a trial where we reasonably believe that a person has previously used a trial, has created multiple accounts or is otherwise attempting to circumvent the one-trial-per-person restriction.
A valid payment method may be required to activate a trial.
Where the sign-up process states that a trial automatically converts into a paid Membership, your Membership will automatically become a paid subscription at the end of the trial unless you cancel before the trial expires.
The applicable Membership Fee will be clearly displayed before you begin the trial.
If you cancel before the trial expires, you will not be charged the Membership Fee.
The availability of a free trial is promotional and temporary. We may introduce, withdraw or change future trial offers without amending these Terms. This does not affect a trial that has already been validly activated unless otherwise required by law.
Your Membership is a recurring subscription.
Unless you cancel it, your Membership will automatically renew each month, and the applicable Membership Fee will be charged to your payment method.
By subscribing, you authorize us and our payment processor to charge the applicable recurring Membership Fee to the payment method provided by you until the Membership is cancelled.
The amount and billing frequency will be displayed before you complete your subscription.
The Membership Fee applicable to you is the price displayed at checkout when you subscribe.
Prices may be displayed in different currencies depending on location or checkout configuration.
Applicable taxes may be added or included as indicated at checkout and as required by applicable law.
Payments are processed through Stripe or another payment processor identified at checkout. We do not ordinarily receive or store your complete payment-card details.
Your use of payment services may also be subject to the payment processor's applicable terms and privacy practices.
If a payment fails, we may attempt to process the payment again and may suspend access to paid features until payment is successfully completed.
We may change Membership prices from time to time.
A price change will not retrospectively affect a billing period that you have already paid for.
Where a price increase affects an existing recurring Membership, we will provide reasonable advance notice as required by applicable law.
You may cancel your Membership before the new price takes effect if you do not wish to continue at the revised price.
You may cancel your Membership at any time through the cancellation functionality made available through your account or, where necessary, by contacting us at info@kristingrube.com.
Cancellation stops future renewals.
Unless applicable law requires otherwise, cancellation does not immediately terminate access. You may continue using the Platform until the end of the billing period for which you have already paid.
After that period ends, your paid access will cease and no further Membership Fee will be charged unless you subsequently subscribe again.
Cancelling a payment card, deleting the Athlete Unsaid application or simply ceasing to use the Platform does not necessarily constitute cancellation of the Membership.
Except where required by applicable law, Membership Fees already charged are non-refundable, including where you stop using the Platform before the end of a paid billing period.
We do not ordinarily provide prorated refunds or credits for unused portions of a Membership.
Nothing in these Terms excludes or limits any refund, withdrawal, cancellation, cooling-off or other consumer right that cannot lawfully be excluded under the law applicable to you.
Where applicable law gives you a statutory withdrawal or cooling-off right, we will comply with that right.
Where permitted by applicable law, you may be asked during checkout to expressly request that access to the service begins immediately and to acknowledge any consequences that immediate performance may have for a statutory withdrawal or cancellation right.
Athlete Unsaid is designed to allow Members to participate in certain discussions anonymously.
Where the anonymous posting function is used, other Members will not be shown your name or ordinary account profile. Instead, the Platform may display a generic anonymous identity together with limited information such as your sport and competitive level.
Because of technical limitations of the Platform, Members cannot individually select which of these designated fields are displayed when using the anonymous function.
Anonymous participation does not mean that the post is technically anonymous to Athlete Unsaid.
The Platform retains the technical ability to associate anonymous activity with the underlying Member account.
We may access this information where reasonably necessary for:
We will not disclose the identity behind an anonymous contribution to other Members except where required by law.
No internet-based system can guarantee absolute anonymity or security. You should therefore avoid including information in a post that could independently identify you if you wish to remain anonymous.
The privacy and trust of Members are fundamental to Athlete Unsaid.
You must not attempt to identify, discover, expose, reveal or publicly speculate about the identity of a Member who has chosen to participate anonymously.
You must not use information obtained through Athlete Unsaid to identify an anonymous Member outside the Platform.
You must also not, without the relevant Member's permission:
This obligation continues after your Membership ends.
A serious or deliberate breach of this Section may result in immediate termination of Membership without refund, subject to applicable law.
You agree to engage with other Members honestly, respectfully and responsibly.
You must not use Athlete Unsaid to:
Members may disagree strongly. Disagreement itself is not a violation. Personal abuse, intimidation and conduct that undermines the safety or purpose of the community may be.
You retain ownership of intellectual-property rights you hold in content that you submit to Athlete Unsaid ("User Content").
By submitting User Content, you grant Context Goods Trading LLC a non-exclusive, worldwide, royalty-free licence to host, store, reproduce, technically process and display that User Content to the extent reasonably necessary to operate, secure, moderate and provide Athlete Unsaid.
This licence does not transfer ownership of your content to us.
We will not use an identifiable private community post as a testimonial, advertisement or external marketing communication without separate permission from the relevant Member.
You represent that you have the right to submit the content you post and that doing so does not unlawfully infringe another person's rights.
Athlete Unsaid is a moderated community.
We may, where reasonably necessary:
We will not materially rewrite a Member's contribution in a way that falsely changes what that Member communicated.
Moderation decisions may take account of context, severity, repetition, community safety and the purpose of Athlete Unsaid.
We are not required to pre-screen every contribution and cannot guarantee that inappropriate content will never appear.
Athlete Unsaid may provide mental-performance coaching, educational information, exercises, questions, observations, discussion prompts and general guidance relating to sport and performance.
Such material may address subjects including confidence, pressure, nerves, mistakes, anger, concentration, motivation, expectations and performance under pressure.
This content is provided for educational and mental-performance purposes only.
Athlete Unsaid is not a medical practice, psychology practice, psychotherapy service, counselling service, psychiatric service or emergency mental-health service.
Nothing provided through Athlete Unsaid constitutes or is intended to constitute:
Participation does not create a doctor-patient, psychologist-patient, therapist-client or other healthcare professional relationship.
Coaching provided through Athlete Unsaid is not a substitute for care from an appropriately qualified healthcare professional.
You remain responsible for determining whether professional medical or psychological assistance is appropriate for you.
Athlete Unsaid is not designed or staffed as a crisis-support environment.
The Platform is not continuously monitored for emergencies.
If you believe that you or another person is in immediate danger or experiencing a medical or mental-health emergency, you should contact the appropriate local emergency service or a qualified healthcare professional.
Content indicating an acute mental-health crisis, self-harm, suicide, dangerous eating-disorder behaviour or other serious and immediate safety concerns may be restricted, hidden, locked or removed because Athlete Unsaid is not an appropriate environment for managing such situations.
Where appropriate and reasonably practicable, we may encourage a Member to seek qualified professional or emergency assistance.
Athlete Unsaid does not undertake a duty to monitor Members for signs of mental illness, crisis or risk of harm.
Members speak for themselves.
Statements, experiences, opinions and suggestions posted by Members do not represent the views of Athlete Unsaid and should not be assumed to be accurate, complete or appropriate for your circumstances.
You should exercise your own judgment before acting on information provided by another Member.
You must not rely upon Member-generated content as medical, psychological, legal, financial or other regulated professional advice.
Except for User Content and third-party material, all rights in Athlete Unsaid, including its branding, original written material, exercises, educational resources, graphics, design elements, software customizations and proprietary content, belong to Context Goods Trading LLC or its applicable licensors.
Membership gives you a limited, personal, non-exclusive, non-transferable right to access such material for your own private use.
You may not reproduce, sell, license, republish, commercially exploit or systematically distribute Athlete Unsaid material without prior written permission.
We aim to provide reliable access but do not guarantee that Athlete Unsaid will operate continuously or without interruption, delay, error or technical failure.
We may temporarily restrict access for maintenance, security, updates or circumstances outside our reasonable control.
We may modify, replace or discontinue particular features where reasonably necessary.
Where a change materially affects the core nature of a paid Membership, we will provide notice where reasonably practicable and where required by applicable law.
We may warn, restrict, suspend or terminate a Member where we reasonably believe that the Member:
Serious violations may result in immediate termination without prior warning.
Where Membership is terminated because of a Member's material breach, fees already paid will not ordinarily be refunded, except where required by law.
We may also discontinue an account or the service for legitimate operational, legal or business reasons. Where we terminate a paid Membership for reasons unrelated to the Member's breach, we will address any unused prepaid period fairly and in accordance with applicable law.
When Membership ends, your right to access members-only areas of Athlete Unsaid ends.
Content you contributed may remain as part of existing community discussions where reasonably necessary to preserve the integrity and context of those discussions.
Where appropriate, content may remain associated with an anonymous or de-identified account rather than your active profile.
Requests concerning deletion of personal data will be handled in accordance with our Privacy Policy and applicable data-protection law.
Sections of these Terms which by their nature are intended to continue after Membership ends – including confidentiality, intellectual property, liability and protection of Member anonymity – will survive termination.
To the fullest extent permitted by applicable law, Athlete Unsaid is provided on an "as available" basis.
We do not guarantee that:
Nothing in these Terms excludes warranties or rights that cannot lawfully be excluded.
To the maximum extent permitted by applicable law, Context Goods Trading LLC will not be liable for indirect, incidental, consequential or special loss arising from the use of Athlete Unsaid, including loss resulting from reliance on Member-generated content.
Nothing in these Terms excludes or limits liability where such exclusion or limitation is prohibited by applicable law, including liability that cannot lawfully be excluded for fraud, fraudulent misrepresentation, death or personal injury caused by negligence, or mandatory consumer rights.
To the extent permitted by applicable law, where liability arising from the paid Membership can lawfully be limited, our aggregate liability arising from the Membership will not exceed the Membership Fees actually paid by you to Athlete Unsaid during the 12 months immediately preceding the event giving rise to the claim.
This limitation does not apply where applicable law requires a higher or unlimited level of liability.
You are responsible for your own use of Athlete Unsaid and for content that you submit.
To the extent permitted by applicable law, you are responsible for losses reasonably incurred by Athlete Unsaid as a direct result of your unlawful conduct, deliberate misuse of the Platform or material infringement of another person's rights.
Nothing in this Section creates liability for a consumer beyond what is permitted under applicable law.
Our collection and processing of personal data is described separately in the Athlete Unsaid Privacy Policy.
Community infrastructure is currently self-hosted on servers located in Germany.
We use third-party service providers for certain infrastructure and operational functions, including hosting infrastructure, email delivery and payment processing.
Further information concerning the categories of personal data processed, purposes of processing, service providers, international transfers, retention periods and applicable data-protection rights is provided in the Privacy Policy.
We may update these Terms where reasonably necessary, including because of changes to the Platform, Membership structure, law, regulation, security requirements or our business operations.
For minor changes that do not materially disadvantage Members, the updated Terms may become effective when published.
If a change materially affects an existing paid Membership or materially reduces a Member's contractual rights, we will provide reasonable advance notice where required by applicable law.
Where applicable law requires consent to a particular change, we will obtain that consent.
If you do not wish to continue following a material change, you may cancel your Membership before the change becomes effective.
We may contact you electronically regarding your Membership, payments, security, moderation, material changes to the Platform or Terms and other information necessary to administer your account.
These service communications are separate from marketing communications.
Where required by applicable law, promotional emails, newsletters and other direct marketing will be sent only with the appropriate consent or other lawful basis, and you may unsubscribe from marketing communications separately.
Unsubscribing from marketing does not prevent us from sending necessary service communications concerning your Membership.
These Terms and the contractual relationship between you and Context Goods Trading LLC are governed by the laws of the United Arab Emirates, as applicable in the Emirate of Sharjah, without prejudice to any mandatory consumer-protection rights that apply to you and cannot lawfully be excluded by agreement.
Nothing in this Section deprives a consumer of protections granted by mandatory laws applicable in the consumer's country of residence where those protections legally apply notwithstanding this choice of law.
We encourage Members to contact us first at info@kristingrube.com so that disputes can, where possible, be resolved informally.
Subject to any mandatory right of a consumer to bring proceedings before another competent court, disputes arising from these Terms shall be subject to the competent courts of the Emirate of Sharjah, United Arab Emirates.
Nothing in this Section limits any mandatory consumer right concerning jurisdiction or dispute resolution.
These Terms, together with the Privacy Policy and any additional terms expressly presented and accepted by you at checkout, constitute the agreement governing your Membership.
If a provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue to apply to the extent permitted by law.
Failure by us to enforce a provision on one occasion does not constitute a waiver of that provision.
You may not transfer your Membership or your rights under these Terms to another person without our consent.
We may transfer our rights and obligations in connection with a legitimate transfer, restructuring or sale of the Athlete Unsaid business, provided that doing so does not unlawfully reduce your rights as a consumer.
